Texas baby removed from life support against mother’s wishes

Tuesday, March 22, 2005Sun Hudson, a six-month old Texas baby died last week when health care providers at Texas Children’s Hospital in Houston, Texas removed his life support system over the objections of his mother. The action was authorized under the 1999 Futile Care Law which was signed into law by then-Gov. George W. Bush.

Under the Texas Futile Care Law, health care workers are allowed to remove expensive life support for terminally ill patients if the patient or family is unable to pay the medical bills.

Sun Hudson’s mother is dealing with the aftermath of that law. “This hospital was considered a miracle hospital. When it came to my son, they gave up in six months,” Wanda Hudson told reporters how she was forced to give up medical control of her son. “I talked to him, I told him that I loved him. Inside of me, my son is still alive.”

The hospital had blocked the media from the child, despite mother’s invitation to see the baby. “I wanted y’all to see my son for yourself. So you could see he was actually moving around. He was conscious,” she said.

The event stirred national attention as it sparked comparisons to the Terri Schiavo case in Florida. A victim of severe, and otherwise terminal brain damage, Terri Schiavo’s future is locked in a legal battle between her husband who wants to remove life support and her parents, who cite religious reasons for keeping their daughter alive.

Michael Schiavo, husband of Terri Schiavo, was asked about the Hudson situation on the March 21 edition of CNN’s Larry King Live. When King asked how Mr. Schiavo felt when he learned that President Bush had signed such a law in Texas while he was governor, Schiavo was at a loss of words.

But Schiavo’s lawyer did respond, saying, “Obviously, there’s a tremendous amount of hypocrisy there … it would lead one to believe that a lot of this was politically motivated, and I think that’s what the American people have concluded.” Schiavo’s lawyer echoed the sentiments of Florida Representative Debbie Wasserman-Schultz, a Democrat, who raised the “hypocrisy” question when she first mentioned the 1999 Texas law issue on the House floor last week.

Over the weekend, President Bush signed a special federal law that moved jurisdiction of the Schiavo case out of the state of Florida and into the U.S. federal court system after Florida courts ruled that Michael Schiavo had the right to remove Terri’s life support, which includes a feeding tube and intravenous liquids.

After signing the Schiavo Law Sunday, President Bush said, “It is wisest to always err on the side of life.”

Thirty fans were arrested and five officers were injured Saturday night in Liverpool following Manchester United‘s 2-0 win at Everton in an FA Cup match up.

Officers in riot gear were called out to the Everton Valley section of the city to separate the rival fans of the teams. It is believed that Ill-feeling marking Wayne Rooney‘s return to Goodison Park erupted outside the ground into what Merseyside Police called “large-scale disturbances”. Officers were hit by rock, bottles, and other projectiles, several needed to be taken to area hospitals for treatment of their injuries.

During the match, a missile from the crowd struck United keeper Roy Carroll. Everton have vowed to ban for life the fan who threw the projectile, believed to be a coin, which injured Carroll. Police also reported recovering a mobile phone which was thrown onto the pitch during the game.

Dave Brockie of rubber-costumed metal act GWAR was found dead in his Richmond, Virginia home late on Sunday. Better known by stage name Oderus Urungus, Brockie was 50.

Founder, singer, leader, and occasional bassist of GWAR, Brockie’s career stretches back to 1984. He and fellow Virginia Commonwealth University art students formed what they dubbed “Earth’s only openly extra-terrestrial rock band”, growing famous for satirical and obscene lyrical themes, and live shows featuring the defilement of effigies and plenty of fake blood.

Fellow founding member Don Drakulich, who still makes props and costumes for the rockers, said he was “very sad” and “shocked”. He said Brockie’s roommate found the corpse. GWAR members changed frequently and the band recovered from the sudden death of guitarist Cory “Flattus Maximus” Smoot during a 2011 tour, but the New York Daily News notes “it’s hard to envision their saga going further” after Brockie’s death.

The band ran with the backstory of crashing to “the most insignificant planet in the universe” 43 million years ago before creating humans by having sex with apes. Becoming encased with ice, the legend ran that upon thawing out in 1984 the members decided to form a band.

Manager Jack Flanagan announced the death via GWAR’s website, adding a post-mortem will be conducted. “My main focus right now is to look after my band mates and his family” he said. Flanagan said another GWAR member found the body.

Brockie said in 2009 “I am one of the blessed people that gets to do what I love to do for a living.” GWAR received a Grammy nomination in 1993, with Phallus in Wonderland up for Best Longform Music Video.

Fellow Virginia rocker Randy Blythe, vocalist for Lamb of God, paid tribute online, writing on Instagram “When someone dies, a lot of the time people will say ‘Oh, he was a unique person, really one of a kind, a true original’ […] I can’t think of ANYONE even remotely like him.”

He never put much stock in ‘limits’

Blythe also took to Facebook. “Right now, if I were to truly honor Dave in the way HE would do it if it were ME that had died, I would make a completely tasteless joke about his death. But I do not have the stomach for that — Dave would, but not me. He never put much stock in ‘limits’.”

Ex-GWAR guitarist Steve Douglas said on Facebook “I have had a few bad days in my life but this one truly ranks right up there. […] you are gone and it is hurting very badly!” “I wish it was a joke” said another ex-member, Chris Bopst. “Everyone is in shock.”

Former bassist Mike Bishop paid tribute in an interview with Style Weekly. “Dave was one of the funniest, smartest, most creative and energetic persons I’ve known,” he said. “He was brash sometimes, always crass, irreverent, he was hilarious in every way. But he was also deeply intelligent and interested in life, history, politics and art.”

A new study by a professor at the University of Oxford has concluded that attending nursery school does not have harmful effects upon “the vast majority” of children under two years old. The research contrasts with the views of other writers in the field, who argue that pre-school children achieve the best results when cared for by their parents full-time.

Kathy Sylva, Professor of Educational Psychology at the university, has based her findings upon data from the Effective Provision of Pre-School Education Project. This has been running since 1996, tracking the development of 3,000 children to discover the effects upon their development of pre-school care and education.

Sylva told The Sunday Times that “[a] lot of parents worry unnecessarily about this issue but my research shows that the vast majority of children are not impaired on any measure by attending nursery under the age of two”, although she admits that there is an increased risk for children from deprived background, and for boys. Those attending better-quality nurseries go on to make better relationships when they start school, she says, and urges parents to check the standards of nurseries for themselves.

Her conclusions come in the wake of a vast expansion in nursery care provision in the United Kingdom in recent years, aimed at getting mothers of young children back to work. One study states that 5% of “middle-class” parents in Britain put their children in full-time nursery care.

According to others such as the child psychologist Oliver James, however, full-time care by parents gives the best results for children. James states that there is evidence that nursery care is “highly stressful and can be harmful”, since levels of the hormone cortisol double after one hour in day care, and raised levels can be detected for some months afterwards. Sylva agrees, though, that some children who attend nursery before they are two are slightly more aggressive at primary school – a finding in line with other research – but says that this aggression disappears by the time the child reaches eleven.

Sylva, a Professorial Fellow of Jesus College, Oxford, was awarded the OBE in 2008. She is a former special advisor to the UK House of Commons and the Scottish Parliament.

On Monday, Russian poet Alexander Byvshev was convicted under Russian criminal code Article 282§1 by a court in Oryol Oblast, a region of Russia, for his 2015 seven-verse poem On Ukraine’s Independence.((ru))Russian language: ?? ????????????? ??????? The prosecution said the poem “incites hatred or enmity, and denigration of human dignity”. Per the ruling, Byvshev is to serve 330 hours of community service and forbidden to teach for three years.

The prosecutor pressed for Byvshev to be imprisoned for two and a half years. The poet did not plead guilty, saying he has the right to express his opinions via the poem.

Byvshev uploaded On Ukraine’s Independence on Russian social network VKontakte (VK) on February 22, 2015. Before Byvshev uploaded the poem, it was published by other Ukrainian websites.

Previously, on July 13, 2015, Byvshev was sentenced to 300 hours of community service for his March 2014 poem To Ukrainian Patriots, for “inciting hatred or enmity”. That poem was about the Russian military’s capture of the Ukrainian region of Crimea, which took place days before he published the poem. He also criticised Moscow’s support for Ukrainian separatists. Since the occupation of Crimea, the clash between the Ukrainian army and separatists has resulted in a death toll of over ten thousand.

On April 4, Byvshev, speaking to Russian website Meduza, said he fulfilled the service requirement by cleaning the streets and cemetery. Byvshev was listed under “List of extremists and terrorists” in June 2015 and hence, his bank account was frozen. He also lost his teaching job. Byvshev used to teach German and French in his hometown, Kromy. Byvshev told Meduza he spent his early childhood in eastern Ukraine, from which his mother came.

On April 3, Byvshev announced via his social media profile on Facebook that a separate criminal case was commenced for other poems.

Speaking to Meduza on April 4, Byvshev said, “People [of Kromy] are afraid to shake my hand. Everyone is cowed […] It came to the point that when I come to a printing shop and ask to scan some documents, they refuse; they are afraid to become accomplices in my ‘crimes’.”

New York Stock Exchange (NYSE) announced last Wednesday that it has agreed definitively to merge with Chicago-based Archipelago Exchange (ArcaEx) and form a new publicly traded, for-profit company known as NYSE Group. This announcement was followed two days later by NASDAQ®, which independently announced a definitive agreement to purchase Instinet Group.

Archipelago and Instinet are innovative e-trading (electronic trading) companies, and formerly were the two largest American rivals to NYSE and NASDAQ, in recent years taking increasingly large portions of their market share. The Securities and Exchange Commission (SEC) and other regulatory agencies still have to review and approve the transactions, particularly with respect to US securities law and antitrust law, in order to ensure that the marketplace remains lawful and competitive.

Other pending issues for NASDAQ include obtaining the approval of Instinet shareholders, as well as customary closing conditions. NYSE must obtain the approval of its members and Archipelago shareholders.

These changes, a reaction to increased e-trading competition and a changed regulatory environment, will result in NASDAQ and NYSE trading each other’s shares and attempting to grab market share, which many hope will drive down transaction costs and ultimately benefit consumers. However, at least one commentator, Dan Ackman writing in Forbes, has noted that the trading commission at the NYSE currently averages less than a nickel (US$0.05) per share, and was less enthusiastic about potential efficiency gains from electronic trading at the exchange.

The transactions are also intended to make the two leading American stock exchanges more globally competitive with such exchanges as the London Stock Exchange, the Frankfurt Stock Exchange, the Toronto Stock Exchange, and the Australian Stock Exchange located in Sydney.

Almost 600 desperate family members and others remained camped outside the Pasta de Conchos coal mine near San Juan de Sabinas, in the northern Mexico state of Coahuila where 65 Mexican miners were trapped by a gas explosion around 2:30 a.m. (0830 GMT) Sunday. Some are threatening to storm the mine while soldiers are trying to keep them calm and rescuers continue to pick through the rock and debris with hand tools, fearing that any power equipment might set off another explosion.

The local newspaper’s headline caused panic by quoting one of over a dozen surviving miners who were close enough to the exits to escape: “They are surely dead,” (La Prensa de Monclova). However, Arturo Vilchis, Civil Protection Director, refused to speculate on the condition of the miners, while Javier de la Fuente, an engineering contractor with mine owner Grupo México S.A. de C.V. also tried to hold out some hope.

The men were each supposed to be carrying oxygen tanks, each with a six hour supply, and there’s some hope that they could reach other oxygen supply tanks, or that some air might be reaching them through the ventilation shafts into which rescuers have been pumping more oxygen since shortly after the explosion.

Juan Rebolledo, vice president of international affairs for Grupo México, assured onlookers that U.S. mining experts were on the way, and officials at the U.S. Mine Safety and Health Administration have confirmed that they’ve sent a specialized equipment truck and several mining experts which should arrive at the mine site on Wednesday afternoon.

Meanwhile Consuelo Aguilar, a spokeswoman for the National Miners’ Union, called for an investigation into Grupo México’s responsibility for the disaster. Pedro Camarillo, a federal labor official, said nothing unusual was found during a routine evaluation in early February.

The government of the United Kingdom has unveiled their strategy to deal with any future influenza pandemic in their Pandemic Influenza Contingency Plan.

The document, based on the World Health Organization‘s framework for responses, explains how the UK would respond to a major outbreak of flu.

Any flu pandemic would differ from the seasonal outbreaks of flu observed worldwide every year. While seasonal flu kills 12,000 Britons annually, a pandemic would affect far more people and could result in the deaths of up to 50,000 people in the UK if there were no medical intervention.

The government will have the power to cancel events where large numbers of people gather, such as football (soccer) matches. It could also advise travel restrictions to and from areas of high infection, but would not be able to enforce any such measures.

Schools might be closed in the event of a flu pandemic, and infected people would be asked to remain at home, although again no quarantine measures could be imposed by the government.

Further plans include education of the public to recognize symptoms of the flu and how to avoid infection.

Measures will be made to maintain basic services in the event of a pandemic despite staff absences through illness.

A major cornerstone of the plan is the prescription of oseltamivir, an oral neuraminidase inhibitor drug that combats influenza. The drug is currently marketed by Hoffman La Roche under the trade name Tamiflu®.

The UK Department of Health intends to stockpile 14.6m courses of the drug over the next two financial years, giving enough to treat one in four of the population – the ratio recommended by the WHO.

Canada and Australia have also bought the equivalent amounts of anti-viral drugs. The U.S. has also bought large amounts of similar drugs.

The total cost of the acquisition was not published by the government, but the BBC estimated the cost to be £180 million.

Unlike a vaccine, oseltamivir can be used to treat any strain of the influenza virus. Many new variants of the influenza virus are seen every year, and combined with the long lead times associated with the development of vaccinces, mass vaccination is frequently impractical.

Some parts of the newly-revealed plan already exist. The UK government recently gave £500,000 to the WHO for survellience of so-called ‘bird flu’ in South East Asia, a possible source for any future pandemic. The Department of Health will also continue to monitor flu-like cases seen by doctors and hospitals.
